What happens when the Geneva Conventions are Violated?

Posted by admin on October 1st, 2009 and filed under conventions | 5 Comments »

Hi everybody, I’m writing a research paper and I was wondering what happens when the Geneva Conventions are violated. If anyone knows the legal consequence please post an answer with a citation. However don’t be afraid of posting a de facto answer.

Thanks for the help.

The World Court has the International legal power to impose a judgment when the rules of the Geneva Convention have been violated and proven. A complaint must be filed with the Court stating the violations. The complaint is normally filed by a Country represented by their attorney.

    The problem with International Law is that there are no real enforcement mechanisms. In the case of violating the Geneva Conventions, the consequences are 1) earning the contempt of the civilized world, and 2) increasing the chances that your own personnel will receive similar treatment once you’ve established the precedent.

    The Geneva Conventions are meaningless to most Muslim countries. The counties that harbor terrorists all violate the conventions; thus we are not obligated to follow them when we fight them. Following are the qualifications to be considered a legal prisoner of war. If the combatants do not qualify under any of these they are not prisoners of war and should not be afforded the privileges defined in the conventions.

    Article 1
    The laws, rights, and duties of war apply not only to armies, but also to militia and volunteer corps, fulfilling the following conditions:

    To be commanded by a person responsible for his subordinates;

    To have a fixed distinctive emblem recognizable at a distance;

    To carry arms openly; and

    To conduct their operations in accordance with the laws and customs of war.

    In countries where militia or volunteer corps constitute the army, or form part of it, they are included under the denomination "army."

    Nothing if you’re powerful. The government here in the good ol’ U.S. of A. trampled all over the Geneva Convention with Guantanamo Bay, but nothing happened.

    If you’re not so powerful, economic sanctions happen, lots of UN interventions, etc.
