    I’m an Obama Democrat, but what Lindsey Graham said, and I mean every word, is true. Problem is, his own Administration, Gonzales, Addington, Yoo, Cheney, Rumsfeld, and others, with the Unitary Presidency Theory that the President can authorize anything he wants (with Bybee and Yoo agreeing by penning that the new definition of torture), and exporting torture to Gitmo and Iraq, I’m not so sure he realizes that talking about being honorable is one thing. Doing it is quite another. We didn’t.

    Graham is a fool. By his own words 2:02 he says that the taliban butcher our people. This isn’t a state run military versus another state military. These are non-affiliated terrorists. I would have asked Graham when we can expect some type of POW exchange with the taliban. The Constitution is not a suicide pact.

    I thought we weren’t obligated by the Geneva conventions? What about the Hague conventions? Those are the ones that regard “treatment of prisoners of war” I believe.

    Are we obligated by those?

    Torture is just immoral and completely wrong and like any thing that is wrong people will try to justify it and say it is okay, like a teenager steeling from a department store and saying it won’t hurt the corporation.
    And to this notion that we have never faced an enemy like the terrorists today, what about the Japanese camacazy in WWII and thier torture? This isn’t a political issue, it’s a moral one.

    Agents can never be prosecuted for War Crimes, and never lose anything. There is no jurisdiction greater than US courts and would never hand them over. Every country can & does define these obligations whenever necessary. He is speaking of the nation-state, of rational individuals, and the terrorists are not part of this argument and should not be considered protected by the Geneva Convention. The Iranians can and would do what it wanted and not give a moment’s thought to the Geneva Convention.
